Terms of service

These terms govern your use of the VelaPay application and the cards made available through it. The service is operated by Bestari Markets Ltd., a company incorporated in Canada under corporation number 1747424-5, with its registered office at Unit 4, 1332 Khalsa Drive, Mississauga, Ontario L5S 0A2, Canada.

By opening an account you agree to these terms. If you do not agree, do not use the service.

1. What the service is

VelaPay lets you fund a prepaid payment card with USDT and spend the resulting balance at merchants that accept the relevant card network. Cards are issued by a licensed issuing partner, not by us. The issuer's own cardholder terms apply to the card itself and are shown to you before a card is opened.

We are not a bank. Balances held on a card are not deposits and are not covered by any deposit insurance scheme.

3. Identity verification

We are required by law to identify our customers. You agree to provide accurate identity information and documents, to complete a liveness check, and to update that information when it changes. We may refuse to open an account, or may suspend or close an existing one, if verification cannot be completed or if the information provided proves to be false.

Fees for opening a card, funding a card, and other operations are shown in the application before you confirm the operation. We may change fees; changes take effect only for operations you carry out after the change is published, and material changes are notified in the application in advance.

7. Prohibited use

You may not use the service:

We may suspend or close an account, freeze a card, and report the matter to the relevant authorities if we reasonably believe this section has been breached.

8. Suspension and closure

You may close your account at any time from within the application, provided no balance or dispute is outstanding.

We may suspend or close your account where we are legally required to, where verification fails or expires, where we reasonably suspect fraud or prohibited use, or where our issuing partner withdraws the underlying card. Where we are permitted to explain the reason, we will.

On closure we will return any remaining balance to you by a method available to us, less any fees or amounts we are entitled to deduct, unless we are legally prevented from doing so.

9. Availability

We aim to keep the service running continuously but do not guarantee it. Access may be interrupted for maintenance, or by failures at our issuing partner, at a blockchain network, or at an infrastructure provider. We are not liable for losses caused by such interruptions, except where the law does not allow us to exclude that liability.

10. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Subject to that, we are not liable for indirect or consequential loss, for loss of profit, or for losses arising from your failure to keep your credentials secure or from your sending funds to an incorrect address or network.

11. Changes to these terms

We may change these terms. The date at the top of this page shows when they were last changed. Material changes are notified in the application before they take effect. Continuing to use the service after that means you accept the change.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes are subject to the non-exclusive jurisdiction of the courts of Ontario. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.
